As such, Snowmass Vacations values you as our guest and recognizes that privacy is important to you. We want you to be familiar with how we collect, use, and disclose information. This Privacy Statement describes the privacy practices of the Snowmass Vacations in connection with information that we collect through websites operated by us from which you are accessing this Privacy Statement, including Snowmassvacations.com and other websites owned or controlled by the Snowmass Vacations (collectively, the “Websites”), through the software applications made available by us for use on or through computers and mobile devices (the “Apps”), through our social media pages that we control from which you are accessing this Privacy Statement (collectively, our “Social Media Pages”), through HTML-formatted email messages that we send to you that link to this Privacy Statement, and through your communications with us when you stay as a guest at one of our hotels or other properties (collectively, including the Websites, the Apps and our Social Media Pages, the “Online Services,” and together with offline channels, the “Services”). By providing Personal and Other Information to us, you agree to the terms and conditions of this Privacy Statement.

COLLECTION OF PERSONAL INFORMATION

“Personal Information” is information that identifies you as an individual or relates to an identifiable individual. We may collect Personal Information such as:

  • Name, gender, home and work address, telephone number and email address, your business title, date of birth, nationality, any form of government-issued identification information;

  • Guest stay information, including date of arrival and departure, goods and services purchased, special requests made, information and observations about your service preferences (including room type, facilities, amenities requested, ages of children or any other aspects of the Services used);

  • Telephone numbers dialed, faxes sent/received, or receipt of telephone messages when connected to the telephone services we may provide guests during their stay;

  • Credit and/or debit card number;

  • Online user accounts details, profile or password details and any frequent flyer or travel partner program affiliation;

  • Employer or other relevant details if you are an employee of a corporate account, a vendor, or other type of business partner (e.g., travel agent or meeting/event planner);

  • Additional contact information for you, our guest, that we may obtain through third parties with whom we do business (e.g. travel agents or similar providers);

  • Profile photo;

  • Social media username or account

If you submit any Personal Information relating to other people to us or to our service providers in connection with the Services (e.g., making a reservation on behalf of another guest), you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Statement.

We and our service providers may collect Personal Information in a variety of ways, including:

  • Through Our Online Services: We may collect Personal Information when you make a reservation or otherwise purchase goods and services from us, communicate with us via a chat service on our websites, inform us of any special requests for your stay, or sign up for a newsletter or participate in a survey, contest, or promotional offer put forth by us.

  • Through Our Offline Services: We may collect Personal Information from you offline, such as when you visit one of our branded properties, make a reservation over the phone, or contact customer service.

  • From Other Sources: We may collect Personal Information from other sources, such as public databases, joint marketing partners, and other third parties. This may include information from your travel agent, airline, credit card, and other partners, and from social media platforms (including but not limited to friends, followers, and other connections). For example, if you elect to log into, connect with, or link to, the Online Services using your social media account, certain Personal Information from your social media account will be shared with us, which may include Personal Information that is part of your or your friends’ profiles.

USE OF PERSONAL INFORMATION

We may use Personal Information in a variety of ways, including:

  • To provide the services you request, such as to make a reservation, send confirmations and prearrival documents, to assist you with planning and facilitating meetings or events, and provide you with other local information concerning the area and property at which you are staying.

  • To successfully complete your reservation; for example, to process your payment, ensure that your room is available, and provide you with service from our reservations agents and front desk staff.

  • To send you mailings such as administrative information, marketing communications, promotional offers, customer satisfaction surveys, or market research studies.

  • To personalize your experience as our guest at our hotels and with respect to the Online Services by presenting products and offers customized specifically for you.

  • To allow you to participate in sweepstakes, contests and other promotions and to administer these activities. Some of these activities have additional rules, which could contain additional information about how we use and disclose your Personal Information. We suggest that you read any such rules carefully.

  • For our business purposes, such as data analysis, audits, security, fraud monitoring and prevention (including through the use of closed-circuit television, card keys, and other security systems), enhancing, improving, or modifying our Services, identifying guest trends, monitoring the effectiveness of our promotional ventures and expanding our business activities to best serve you, our guest.

  • By submitting your phone number, you grant consent to receive SMS messages from us pertaining to our services. You retain the option to opt-out of these messages at any time.

DISCLOSURE OF PERSONAL INFORMATION

Your Personal Information may be used in connection with the following services:

  • Reservations: The Personal Information you provide to us during the reservation process is made available to the applicable party to confirm your reservation. The unit may be owned and managed by Snowmass Vacations directly, or it may be owned or managed by a third party associated with Snowmass Vacations. Following your stay, we will retain your Personal Information, including details of your stay, preferences, and accommodation type, to better provide you with personalized service for future reservations.

  • To Service Providers: We may disclose Personal Information to our third-party service providers who provide services such as spa treatments, as well as any restaurants within our properties, payment processing, website hosting, order fulfillment, information technology and related infrastructure provision, data analysis, customer service, email communications, auditing, and other services.

  • Travel Related Services: We may share your Personal Information with select third-parties with whom we have agreements which allow them to offer Snowmass Vacations-branded products to you, our guest. For example, this sharing enables these third-parties to provide you with a single source for purchasing travel packages that may include other services such as airline tickets or rental cars. Please note that this Privacy Statement does not address any information you subsequently provide directly to one of these third-parties, such as information necessary to reserve a rental car or book a flight.

  • Sponsors of Sweepstakes, Contests and other Promotions.

  • Corporate Reorganization: We may disclose your Personal Information to a third-party in the event of any reorganization, sale, merger, joint venture, transfer, reassignment, or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceedings).

We may also use and disclose your Personal Information as is appropriate and necessary, including but not limited to: (a) under applicable law, including laws outside your country of residence; (b) to comply with due legal process; (c) to respond to requests from public and government authorities, including public and government authorities outside your country of residence; (d) to enforce Snowmass Vacations’ terms and conditions; (e) to protect Snowmass Vacations’ operations or those of any of our affiliates; (f) to protect Snowmass Vacations’ rights, privacy, safety or property, and/or that of our affiliates, you, or others; and (g) to allow Snowmass Vacations to pursue available remedies or limit any damages we may sustain.

COLLECTION OF OTHER INFORMATION

“Other Information” is any information that does not reveal your personal identity, or does not directly relate to a specific individual, such as:

  • Browser and device information

  • App usage data

  • Information collected through cookies, pixel tags, and other technologies

  • Demographic information and other information provided by you, our guest

  • Aggregated information

If we are required to treat Other Information as Personal Information under applicable law, then we may use it for the same purposes for which we use and disclose Personal Information as detailed in this Privacy Statement.

We and our third-party service providers may collect Other Information in a multitude of ways, including:

  • Through your browser or handheld device: Certain information is collected by most browsers or automatically through your device, such as your Media Access Control (MAC) address, computer type (Windows or Macintosh), screen resolution, operating system name and version, device manufacturer and model, predominant language on the device, Internet browser type and version, and the name and version of the Online Services (such as the apps) you are using. We use this information to ensure that the Online Services function properly.

  • Through your use of apps: When you download and use an app, Snowmass Vacations and Snowmass Vacations’ service providers may track and collect app usage data, such as the date and time the app on your device accesses our servers as well as what information and files have been downloaded to the app based on your device number.

Using cookies: Cookies are pieces of information stored directly on the computer or mobile device that you are using. Cookies allow us to collect information such as browser type, time spent on the Online Services, pages visited, and other aggregated usage data. Snowmass Vacations and our service providers use the information for security purposes, to facilitate navigation, to display information more effectively, to collect statistical information, to personalize your experience while using the Online Services, and to recognize your computer to assist your use of the Online Services, such in making a reservation on one of our sites. We also gather statistical information in order to continually improve our Online Services’ design and functionality, understand how they are used by you, our guest, and assist Snowmass Vacations with resolving questions regarding them.

Cookies also allow us to select which of our advertisements or offers are most likely to appeal to you, our guest, and display them to you while you are using Online Services or to send you advertisements and marketing emails. We may also use cookies or other technologies to track responses to our online advertisements and marketing emails. Using pixel tags and other similar technologies: Pixel tags (also known as web beacons and clear GIFs) may be used in connection with some Online Services to, among other things, track User activity of the Online Services (including email recipients), assess the success of our marketing campaigns, and accumulate statistics about usage of the Online Services. We also utilize Google Analytics and Facebook Analytics, which uses cookies and similar technologies to collect and analyze information about use of the Online Services as well as report on activities and trends. These services may collect information regarding the use of other websites, apps, and online resources. IP Address: A User’s IP address is a number that is automatically assigned to the computer that a User is using by their Internet Service Provider (ISP). An IP address may be identified and logged automatically in our server’s files whenever a User accesses the Online Services, along with the time of the visit and the pages that were visited. Collecting IP addresses is standard practice and is done automatically by many websites, apps, and other services. Snowmass Vacations uses IP addresses for calculating usage levels, diagnosing server problems, and administering the Online Services, among other things. We may also derive your approximate location from your IP address.

  • Physical Location & Mobile Location-Based Services: Snowmass Vacations may collect the physical location of a User’s device by using satellite, cell phone tower, Wi-Fi signals, or other technologies. Snowmass Vacations may use this location to provide you with personalized location-based services and content, including enabling you to find a hotel near you.

    We may also share your device’s physical location, combined with information about which advertisements you viewed and other information, with our marketing teams to enable them to provide you, our guest, with more personalized content and to examine the effectiveness of advertising campaigns. In some instances, you may be permitted to allow or deny such uses and/or sharing of your device’s location; however, if you choose to do so, we and/or our marketing partners may not be able to provide you with the appropriate levels of personalized services and content.

  • Aggregated Personal Information: Aggregated Personal Information does not personally identify you or any other user of the Services (for example, we may aggregate Personal Information to calculate the percentage of Users who possess a specific area code).

USE AND DISCLOSURE OF OTHER INFORMATION

We may use and disclose Other Information for any purpose, except where we are required to do otherwise under applicable law. In some instances, we may combine Other Information with Personal Information (such as combining your name with your location). If we do, we will treat the combined information as Personal Information.

  • Third Party Services: This Statement does not address, and we are not responsible for, the privacy, information, or other practices of any third parties, including any third-party operating any site or service to which the Services link, third-party payment portals, or any third-party website that is the landing page of our properties. The inclusion of a link on any Online Service does not imply endorsement of the linked site or service by us or by our partners or affiliates. We have no control over, and are not responsible for, a third-party’s collection, use, and disclosure of your Personal Information.

Additionally, we are not responsible for the information collection, use, disclosure, or security policies or practices of other organizations, such as Facebook, Apple, Google, Microsoft, RIM, or any other app developer, app provider, social media platform provider, operating system provider, wireless service provider, or device manufacturer, including with respect to any Personal Information you disclose to other organizations through or in connection with the Apps or our Social Media Pages.

  • Third Party Advertisers: We may use third-party advertising companies to provide promotions regarding goods and services that may be of interest to you, our guest, when you access and use the Online Services. Ads may be based on information relating to your access to and use of the Online Services and other websites or online services. To do so, these companies may place or recognize a unique cookie on your browser (including through use of pixel tags).

We take the security of your data very seriously at Snowmass Vacations. Transparency is one of our core principles, we aim to be as transparent as we can about the way we handle your security.

These measures include, but are not limited to:

  • Anti-virus protection and detection of intrusion attempts

  • Encrypted data transmission using SSL/https/VPN technology

  • Tier 3 and PCI DSS certified data centers

We seek to use reasonable organizational, technical, and administrative measures to protect Personal Information within our organization. CHOICES, ACCESS AND RETENTION

If you no longer want to receive marketing-related emails from us, you may opt out by visiting our unsubscribe page or by following the instructions in any email you receive from us.

We will try to comply with your request as soon as we are able to do so. Please note that if you opt out of receiving marketing-related emails from us, we may still send you important administrative messages, such as details about upcoming reservations, which you may not opt out of.

Within 30 days of receiving such a request, we will provide a list of the categories of personal information disclosed to third parties for third-party direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of these third parties. This request may be made no more than once per calendar year. We reserve our right not to respond to requests submitted to addresses other than the addresses specified in this paragraph.
